I told her I liked it and Ill take it and so I filled out the paper work for the apartment I thought everything went smoothly .I was then told trhey had to do a land lord referece history but today I got a letter from the manager saying that I was rejected because of poor landlord references. the letter said I have 14 days to respond and have a meeting to discuss the reasons and even appeal the decision. should I irequest a hearing to find out why . or just talk to the landlord myself first? any advice would be appreciated thankyou

If you really want the apartment, you should request a hearing and do it soon. Although it says that you have 14 days to respond, the prospective landlord isn't going to want to wait that long so if you don't respond soon, you may find the place has been rented out already. An altercation is a pretty serious violation. If you plan to appeal the decision, you'd better have some good reasons why you fought with someone else. Hint: just about the only reasonable defense for coming to blows with someone is because you needed to protect yourself or someone you know. Any reason you give other than this will be unsatisfactory.

Hello, I live in New York City and I had to take my landlord to court to get a new lease, as they were holding it back from me becasue they thought I was subletting the place. (I had a roommate that couldn't pay rent and I asked him to move out and I guess his way of "paying me back" was to lie to the landlord and tell them that I was subletting the apt, which I wasn't). I was wrongfully evicted (they just changed the locks on me) and I had to take them to court to get it overturned. The judge said the case was a waste of time. Their claim was that I abandoned the apt but it made no sense, because I had previously ask for the new lease. Long story short, the judge said it sounded like miscommunication and that if that what is was then to give me the lease to sign. He sent us out the courtroom to settle the matter. I was granted the lease by the landlord and their attorney. Now, I get a bill in the mail asking for their attorney fees of $956.00. This is outrageous to me! They didn't win anything and I'm pretty sure that they aren't entitled to this fee. Please help me out. I know a little about the law, and even if I didn't commonsense would tell me that this has bogus written all over it. I want to respond with a letter tellign them that I am not paying, but I'd like to put in a legal reference in the letter showing them that I'm not responsible for it. Can anyone help me out? Typically unless there is a written contract to the countrary, all legal fees are paid by their respective parties unless the court orders fees to be paid by one side. You need to respond back to the landlord politely requesting them to explain WHY they feel you are responsible for the debt. (check the old and the new lease first.. maybe it is in there). Once they respond THEN you will know how to respond. Keep in mind that if you DO owe the money and do not pay it, you will likely get evicted again. Sounds like, either way, you should start looking for a new place because this landlord wants you OUT and it is better to have control over your departure then to leave it in his/her hands. . . .

My roommate and I didn't know we were going to move out tell now. Our lease ended this month (on the 10th) and we have not signed a new one just yet. We found a house we like and put in an application and our current landlord will not give a reference or a reference letter to the new landlord. A previous occupant of my rental home has approached me asking for a reference letter for a new rental home. I have never asked for such a letter, and have never written one, so I'd like some advice from another landlord on how this should be worded. The tenant was excellent, I just am not the best at putting such things into proper terms. Not a commercial landlord, just got a few places I rent out.

Also our landlord is my sister in law who hates her brother (my husband) and is threatening to evict us. She has no right to we pay and are good tenants. I know she would say bad things about us. Your going to have to be upfront with the landlord of any prospective place and explain the situation and hope the landlord would be willing to take a leap of faith for yourselves. Being honest is the best approach. Stability of income is important. You might want to also state your job is permanent, as in your not in a probation period. I would not look for places with rent high enough to make it tight on your cashflow. You should be looking for places that are not only within your means but perhaps cheaper places that gives the landlord confidence that you are able to make your monthly obligation of rent no problem. A reference from your friend may not make any difference as often landlords are wary of references from friends in that friends can potentially say anything to simply help you out. Be prepared to have your deposit ready, any delay on being able to pay at least a deposit to secure the place may be reason enough to decline your application. Good luck.

How can I sort-out a Formal Demand notice sent to me by E-on for Gas supply, and which I think is not fair?

Recently I faced a problem with E-on (UK). They send me a Formal Demand notice (via their credit collector company) asking me to pay over £200 to them for Gas (for 3 months), for a property I was renting from 2005 – 2009 (2008 was the time I transferred the Gas contract to another provider). The case is a bit complicated since from 2005 – 2008 there was 1 meter for 2 flats, (the bill was coming as a total amount for both flats) and there was Not any agreement or contract with between me and E-on (both the Gas and electricity supply was already with E-on when I arrived in this flat); and the landlord had the contract. Due to this reason the amount that I supposed to pay was calculated by the landlord. So, I was giving the amount to the landlord and he was paying it. When finally the landlord instructed E-on to put 2 meters, E-on asked him the tenancy agreements for both flats and of-course the landlord gave them the contracts. 3 months after the change of the meter (from 1 meter for 2 flats, to 2 meters for each flat) I transferred the Gas supply to E-Power. Now almost 3 years after E-on asks me to pay, claiming that the landlord said to them that I was responsible for the bills and I have to pay the outstanding amount - which the landlord claims that it is not true (this is what he said to me on a phone conversation I previously had with him). One month earlier I sent them an e-mail where I explain my questions and saying that I find illegal the way they use my personal details and asking them to stop the formal demand since I was not responsible for this bill. Of-course they didn't reply to my e-mail and from that day every time I speak on the phone with E-on they say that they have classified my case as a 3rd party dispute and they mention different things, ie sometimes they change the bill dates, and they recently started to claim that this amount is not only from Gas but also from electricity (how is that possible since the electricity supply was with a key – pay as you go). Finally, E-on and their debit collector company they rush me to pay the bill and then if I have a problem / don't agree with the payment to claim it back from the landlord. Could you please advise me what to do because I don't have any more the contracts between me and the landlord and I don't have any receipts from my payments to that landlord. The only thing I have is a reference letter from the landlord to me where he says that I have been excellent tenant and I was always paying the rent on time.
